1. Important Notice & Scope
[[PLACEHOLDER — REPLACE WITH LAWYER-REVIEWED TEXT]] This document is a draft prepared for internal review only. It is not legal advice and must be reviewed, completed, and approved by qualified counsel admitted in Germany/the EU before publication or reliance.
This Billing, Renewal & Refund Policy explains how subscriptions to my-own-dolls.com (the "Service") are charged, renewed, cancelled, and (where applicable) refunded. The Service is an 18+ subscription platform operated by [[PLACEHOLDER: LEGAL ENTITY NAME]], [[PLACEHOLDER: REGISTERED ADDRESS]], [[PLACEHOLDER: COMPANY REGISTRATION NO.]], VAT/USt-IdNr. [[PLACEHOLDER: USt-IdNr / VAT ID]] ("we", "us", "operator"). Access is restricted to verified adults within a closed user group in accordance with the German Jugendmedienschutz-Staatsvertrag (JMStV) and applicable youth-protection law.
This Policy forms part of and should be read together with our Terms of Service, Privacy Policy, and Cancellation/Withdrawal information. In the event of a conflict, the mandatory consumer-protection provisions of applicable EU and German law prevail. Billing questions should be directed to [[PLACEHOLDER: BILLING SUPPORT EMAIL]].
2. Subscriptions, Recurring Billing & Auto-Renewal
Access to the Service is sold as a recurring subscription. By starting a subscription you expressly authorise us and our payment processor(s) to charge your selected payment method, on a recurring basis, the then-current subscription fee for each successive billing period until you cancel. The billing cycle (e.g. monthly, quarterly, annual) and price are shown clearly on the checkout/order page before you confirm, and you must actively confirm the order (the "order button" labelled in line with §312j BGB, e.g. "zahlungspflichtig bestellen" / "Order with obligation to pay").
Your subscription renews automatically at the end of each billing period for a further period of the same length, at the then-current price for that plan, unless and until you cancel before the renewal date. We will not silently extend a fixed-term subscription into a longer or more expensive commitment; any change to the renewal term, frequency, or price will be disclosed and, where required, separately consented to.
Before each automatic renewal we will, where required by applicable law (including EU/German consumer rules on automatically renewing contracts), send a renewal reminder to your registered email containing the renewal date, the amount to be charged, the discreet billing descriptor, and a direct link to cancel. Promotional, trial, or introductory prices apply only for the stated period; unless cancelled beforehand, the subscription continues at the standard recurring price disclosed at sign-up.
[[PLACEHOLDER — REPLACE WITH LAWYER-REVIEWED TEXT: confirm minimum contract terms, renewal-notice timing, and maximum permitted notice periods consistent with current German law (e.g. rules limiting auto-renewal terms and notice periods for consumer contracts).]]
3. Discreet Billing Descriptor
We use a neutral, discreet billing descriptor so that the nature of the Service is not disclosed on your bank, card, or processor statement. Charges from us typically appear as [[PLACEHOLDER: DISCREET BILLING DESCRIPTOR, e.g. "MOD-MEDIA"]] or a similar variant assigned by the relevant payment processor.
The descriptor, together with a customer-service contact, is displayed at checkout and on your receipts so that you can recognise the charge. If you see a charge you do not recognise, please check the descriptor and your subscription history in your account first, then contact [[PLACEHOLDER: BILLING SUPPORT EMAIL]] before disputing the charge with your bank.
Descriptors are controlled in part by our processors and card networks and may change; we will keep the descriptor information in your account and receipts up to date so the charge remains identifiable.
4. Accepted Payment Methods, Currency & VAT
Accepted payment methods are shown at checkout and may include [[PLACEHOLDER: ACCEPTED METHODS, e.g. Visa, Mastercard, SEPA Direct Debit, [other]]]. Payments are processed by our third-party payment service provider(s) [[PLACEHOLDER: PROCESSOR NAME(S)]]; we do not store full card numbers ourselves. You must use a payment method you are authorised to use and keep your billing details current. Adult-content transactions are additionally subject to applicable card-network rules (including Visa and Mastercard adult-merchant requirements), which we and our processors must follow.
Prices are displayed in [[PLACEHOLDER: CURRENCY, e.g. EUR]]. If you pay in a different currency or your bank applies conversion, foreign-exchange and card-issuer fees may apply and are outside our control.
Prices are stated [[PLACEHOLDER: inclusive / exclusive]] of value-added tax (VAT/USt.). VAT is charged at the rate applicable to electronically supplied services based on your place of residence/consumption, as required under EU VAT rules. For consumers in the EU we collect and remit VAT at the applicable national rate; a VAT-compliant receipt is available in your account. Business customers may be asked to provide a valid VAT/USt-IdNr. where the reverse-charge mechanism applies. [[PLACEHOLDER — REPLACE WITH LAWYER-REVIEWED TEXT: confirm OSS/MOSS registration, applicable VAT treatment per customer location, and invoicing requirements.]]
5. How to Cancel (Click-to-Cancel)
You can cancel your subscription at any time, easily and without giving a reason. Cancellation is available through a clearly labelled cancellation button/flow in your account dashboard under [[PLACEHOLDER: ACCOUNT > BILLING/SUBSCRIPTION PATH]] — the same simple, online way you used to subscribe ("click-to-cancel", consistent with the German Kündigungsbutton requirement under §312k BGB). You do not need to call, email, or speak to anyone to cancel, though you may also cancel by emailing [[PLACEHOLDER: BILLING SUPPORT EMAIL]] if you prefer.
When you cancel, your subscription will not renew for the next billing period. Unless a mandatory withdrawal/refund right applies (see Sections 6–7), cancellation takes effect at the end of your current paid period: you retain access to the Service until that period ends, and you are not charged again thereafter. You will receive an on-screen confirmation and an email confirming the cancellation and the date your access ends.
Cancelling a subscription stops future billing but does not by itself delete your account or personal data; see our Privacy Policy for data retention and deletion. [[PLACEHOLDER — REPLACE WITH LAWYER-REVIEWED TEXT: confirm the cancellation button wording, confirmation-page requirements, and timing rules under §312k BGB.]]
6. EU Right of Withdrawal & Digital-Content Waiver
As a consumer in the EU, you generally have a statutory right to withdraw from a distance contract within 14 days without giving a reason. However, special rules apply to digital content and digital services that are supplied immediately upon purchase, such as access to our galleries.
If you request immediate access to the digital content/service before the 14-day withdrawal period expires, the law requires that (a) you expressly consent to immediate performance, and (b) you acknowledge that you thereby lose your right of withdrawal once performance has begun (for digital content not on a tangible medium) or that you must pay a proportionate amount for the service used before withdrawal (for digital services). At checkout you will be asked to provide this express consent and acknowledgement before access is granted; if you do, your statutory withdrawal right may be extinguished or limited accordingly as permitted under EU/German law.
If you do not give that consent, you may exercise your 14-day withdrawal right using the model withdrawal form or any clear statement sent to [[PLACEHOLDER: WITHDRAWAL/CONTACT EMAIL OR ADDRESS]]. Full statutory withdrawal instructions and the model form are provided separately in our Withdrawal/Cancellation Notice (Widerrufsbelehrung). [[PLACEHOLDER — REPLACE WITH LAWYER-REVIEWED TEXT: insert the compliant Widerrufsbelehrung, the exact consent/acknowledgement wording, and confirm treatment of digital content vs. digital service under §§356(5), 327c BGB and the Digital Content Directive.]]
7. Refund & Cancellation Policy
Except where a mandatory statutory right (such as a valid withdrawal right under Section 6, or rights arising from defective/non-conforming digital content) requires otherwise, subscription fees are generally non-refundable once a billing period has begun and access has been provided, because the Service is digital content/services made available immediately. Cancellation stops future renewals; it does not, by itself, entitle you to a refund of the current period already paid.
We may, at our discretion and in addition to your legal rights, offer a refund or partial credit in cases such as duplicate charges, proven technical inability to access purchased content for a material period, or billing errors. To request a refund, contact [[PLACEHOLDER: BILLING SUPPORT EMAIL]] with your account email, the transaction date, and the billing descriptor; we aim to respond within [[PLACEHOLDER: NUMBER]] business days. Approved refunds are issued to the original payment method.
Nothing in this Policy limits your non-waivable statutory rights as a consumer under EU/German law, including remedies for digital content or services that are not as described or not fit for purpose. [[PLACEHOLDER — REPLACE WITH LAWYER-REVIEWED TEXT: confirm refund commitments, statutory conformity/warranty remedies for digital content, and any card-network-mandated refund timelines.]]
8. Chargebacks & Dispute Guidance
If you believe a charge is incorrect, please contact us first at [[PLACEHOLDER: BILLING SUPPORT EMAIL]] so we can resolve it quickly. Most issues — unrecognised descriptors, accidental renewals, or duplicate charges — can be fixed faster directly with us than through a bank dispute.
Initiating a chargeback or payment dispute with your bank or card issuer without first contacting us may be treated as a breach of our Terms where the underlying charge was legitimate. Because the Service involves an identity- and age-verified closed user group, we may retain and, where lawful, present transaction, access, and verification records to the payment processor or card network to respond to a dispute, consistent with our Privacy Policy and applicable card-network rules. Fraudulent or abusive chargebacks may result in suspension or termination of your account and recovery of associated fees.
If you do not recognise a charge because someone used your payment method without authorisation, contact your bank and us immediately so we can investigate and, where appropriate, secure the account. [[PLACEHOLDER — REPLACE WITH LAWYER-REVIEWED TEXT: confirm permissible dispute-evidence handling, data-protection basis for sharing verification records, and chargeback-fee recovery clauses.]]
9. Failed Payments & Dunning
If a scheduled charge fails (for example, due to insufficient funds, an expired card, or a declined SEPA debit), we may attempt to collect payment again over a short period and notify you by email so you can update your payment details. During this dunning process your access may be limited or suspended until payment succeeds.
Please keep your payment method and billing information current in your account. If payment cannot be collected after our reasonable retry attempts and notices, we may suspend or terminate the subscription. Suspension or termination for non-payment does not waive amounts already due for periods in which access was provided. Where a SEPA Direct Debit is returned, the bank or our processor may charge a returned-debit fee, which may be passed on to you where legally permitted.
[[PLACEHOLDER — REPLACE WITH LAWYER-REVIEWED TEXT: confirm the number and timing of retry attempts, dunning-notice content, default-interest/late-fee provisions permissible under German law, and returned-debit fee handling.]]
10. Changes, Contact & Dispute Resolution
We may update prices and this Policy for future billing periods. Material changes (including price increases) will be communicated to you in advance with the effective date, and where required by law we will obtain your consent or give you the right to cancel before the change takes effect. Continued use after the effective date constitutes acceptance of the updated terms to the extent permitted by law.
For all billing, renewal, cancellation, and refund matters, contact [[PLACEHOLDER: BILLING SUPPORT EMAIL]] or write to [[PLACEHOLDER: REGISTERED ADDRESS]]. We aim to acknowledge billing enquiries within [[PLACEHOLDER: NUMBER]] business days.
As an EU consumer you may also use the European Commission's Online Dispute Resolution (ODR) platform and may have access to a consumer arbitration/conciliation body. We are [[PLACEHOLDER: willing / not willing / obliged]] to participate in dispute-resolution proceedings before a consumer arbitration board. [[PLACEHOLDER — REPLACE WITH LAWYER-REVIEWED TEXT: confirm ODR/consumer-arbitration disclosures, governing law, and any DSA point-of-contact references required for the platform.]]
